There are always two sides to every story and when you enter into an agreement with a contractor, your idea of what the job should entail might be very different from what the contractor thinks about the job.
The only way to avoid a nasty battle and possible court date is to use this Independent Contractor Agreement so the details of the job are filled out completely and both parties sign off, indicating they both understand the job. Include the completion deadlines, when payment is expected, and any other details or scenarios you can think of.
Does the contractor hire subcontractors regularly? Are they insured? Will there be penalties if the contractor doesn’t show up for any reason? These are all things that you should think about and can add to this independent contractor agreement.
As always, our attorneys make us say it… these forms are for reference only and you should always pass any forms you use for your business by a competent attorney in your local area to make sure they jive with all state, federal, and local law.
